2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
3. All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
4. Keep the property and all furnishings in good order
5. Only use appliances for their intended uses
6. Pets are NOT allowed
7. Parking:
PARKING – Parking is limited to 1 vehicle. Vehicle is to be parked in designated parking area only. Parking on the road is permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

8. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units.
9. Jacuzzi: When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. No children under the age of 12 permitted in hot tubs at any time without adult supervision. The building staff drains, sanitize, refill and replenish chemicals with a schedule of the building; the Jacuzzi is closed in the evenings.
10. Storms:
• If there is a storm or hurricane, no refunds will be given please insure your vacations.
• The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or
Cancellation Policy: If Guest wishes to cancel his/her reservation, the reservation deposit will be refunded as follows:
100% if cancelled 90 days prior to the Check-in Date + Bank/Credit Card charges
50% if cancelled 60 days prior to the Check-in Date + Bank/Credit Card charges
25% if cancelled 30 days prior to the Check-in Date + Bank/Credit Card charges
0% if cancelled 29 days prior to the Check-in Date or less
Rental Agreement:
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned owner, manager or agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.

OCCUPANCY

Guest agrees that no more than 6 persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.

Minimum Stay: This property requires a 3 night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is used for less than 3 days, the guest will be charged the normal $490.00/night rate.

TERM

The lease begins at 4:00 PM. on the “Check-in Date” and ends at 11:00 AM on the “Checkout
Date” for # nights rented.

CONDITION AND USE OF PROPERTY

The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as Dishwasher, Microwave, Electric Stove & Range, Fridge & Freezer, Coffee Machine & Espresso Coffee Machine, Toaster, Blender,
Kettle, Electrical can opener. Rental Agent shall not be held responsible for such items failure
to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as hot tubs, pools, spas, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.

Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

DEFAULT

If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made

and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

ASSIGNMENT OR SUBLEASE

Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.

RISK OF LOSS AND INDEMNIFICATION

Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.

Guest hereby covenants and agrees to indemnify and hold harmless Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorney’s fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases.

RELEASE

Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.

ENTRY AND INSPECTION

Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.

UNAVAILABILITY OF PROPERTY

In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be

terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

ADDITIONAL TERMS TO THE RENAL AGREEMENT

In addition to the standard terms included herein, Guest acknowledges and agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:

GENERAL PROVISIONS

This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. This Agreement shall be governed by the laws of the State of Florida. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.

Best Deal In Miami!

This place has it all. A pool over looking the ocean, secured parking, access to public transportation, walking distance to one of the hottest places in Miami (Brickell), and a $30 cab ride from South Beach. The owners are fabulous people who are accommodating and pleasant. I will definitely be coming back again.

UM Graduation

The condo is beautiful and in a wonderful location! Many restaurants are in the area and are within walking distance. It is also within minutes of beautiful Coconut Grove as well as South Beach. The owners go out of their way to make sure your stay is perfect! Everything about this rental is highly recommended!

Perfect Miami Introduction

Great first visit to Miami. The condo was very comfortable, very clean, and had a gorgeous, enormous view. The balcony is on the south side of the building and allows sweeping views to the horizon over Biscayne Bay in the direction of Key Biscayne. The city lights at night make for enjoyable balcony moments after dark.The Brickell neighborhood is immediately south of the old downtown. It is the financial district of Miami and is very walkable. A 5 to 10 minute walk will get you to a wine/cigar shop, artisan bakery, fresh pasta store (made-on-site), Publix supermarket, Walgreens, full-service postoffice, and all the restaurants, bars, and delis you need for many days of eating out. The condo building is right on the water (good for balcony breezes) and has its own restaurant on the first floor. There is also a little grocery store on the second floor that packs a lot of useful items into its small space. It was very handy for many spur of the moment needs and forgotten things. You do have your own inside secured parking space, but you can do much here without a car. At the base of the building is the water and good walking can be had along the water either north or south. 5 minutes north is the Brickell Key(island) with its 1.1 mile perimeter sidewalk, all on the water's edge. There is also a deli-grocery on Brickell Key worth looking at. A 15 minute walk to the north is downtown with all its shopping and dining and more waterfront walks. In addition to a good bus service there is a free trolley and a free elevated "PeopleMover" that cover a several mile area. The owner, Arcelia, lives in the building and was a very gracious and helpful host. She was very accomodating of our departure and arrival times, and was quick to respond to any questions we had. Her condo was a great home base in a beautiful location. My wife and I hope to stay with Arcelia again and can highly recommend her unit

Amazing vacation!!!

I am so glad that I booked this penthouse for my vacation! I couldn't have asked for a better location. The view was breathtaking and the suite was so comforting... Felt right at home!!! Arcelia was an amazing host and was so helpful with making sure my friends and I had the best stay ever. I loved that everything I needed was within walking distance. All around, PERFECT stay, HIGHLY recommended, and I will definitely be booking in the future!!!

Exactly as described, Very Comfortable

We stayed at this unit for a brief family reunion. I was traveling with my wife and young daughter and my parents. Arecelia was a fantastic help in getting us into the unit, parking garage and arranging a sleep area and high chair for our 18 month old. The unit was bright, clean and very functional. The views are incredible and the onsite parking access made travel very easy. We took full advantage of the pool and exercise room and loved walking along the promenade in the mornings. We had considered staying on Key Biscayne but looking back that would have made for much longer travel to get to other parts of Miami. This was the perfect location for visiting South Beach, Key Biscayne and North Miami. Would absolutely come back again.

Stunning!!!

My girlfriends and I rented this property for a weekend and it was absolutely stunning! The owners were awesome and made sure all of our needs were met. They even assisted us with unpacking our car and putting away our groceries! I would definitely recommend this property!

Ocean views with all the amenities! Easy, amazing rental!

The unit was exactly as described, but nothing can prepare you for the views! Located on one of the penthouse floors, the balcony offers amazing views of the ocean and Miami. The unit itself was remarkable, and including any possible amenity you could think of needing on a vacation. Arcelia was easy and great to work with, and you have the added bonus of having her in the building in case you need something. The apartment was very comfortable and updated. The condo also features a concierge service, so we always felt safe and taken care of by the staff. Although it's not a hotel, the condo does have a restaurant and bar on the first floor which we loved. The area can't be beat either! It's in Brickell, right on the water. It's a short cab ride or (free) PeopleMover trip to downtown Miami or even South Beach. You get the all the fun of Miami without the fuss or tourists. I would definitely recommend this place to anyone looking to maximize their comfort and Miami experience for a vacation.

Fabulous Experience and Condo

The unit is exactly as pictured, although the photos really don't do justice to the stunning view. The condo is quite, clean and in wonderful condition. The rooms are spacious and comfortable. The building features a restaurant and bar, as well as a small market and concierge, while not a hotel these features add to the experience. I was staying here with a group of friends for a vacation and we had no trouble getting around. The area is very nice, easy to walk to some restaurants and bars and easy to pick up a taxi (or drive if you have a car) to south beach or other areas. The owner Arcelia is extremely sweet, accommodating and knowledgeable. She made the entire rental process from the initial contact through our departure enjoyable and as easy on us as possible. I look forward to renting from her again the next time I am in Miami.
