The following terms and conditions are part of this agreement and are agreed upon by all parties hereto:
1. SECURITY DEPOSIT. Security deposit will be held in trust by LANDLORD and will be released within 20 days from departure, subject to the following conditions:
a.Renter leaves property and contents in the same condition as received, normal wear and tear accepted.
b.All keys have been returned to the Landlord and the Landlord has conducted a satisfactory inspection of the dwelling’s inventory. In the event that the above conditions are not met and the security deposit is insufficient tocompensate for the damages, the RENTER shall pay Landlord whatever sum is necessary to do so.
2.RULES. RENTER agrees by the rules and regulations governing the property. The OWNERS shall not be liable for any bodily injury or property damage which may arise in connection with the RENTER’S occupancy of the dwelling. The RENTER agrees to indemnify and hold the owners harmless for any damages, injury, claim or liability which may arise in connection with RENTER’S occupancy of the dwelling.
3.PETS. No pets shall be permitted. Any violation of this provision will be considered a breach of contract. Tenancy will be immediately terminated and RENTER forfeits all rent and security monies.
4.CLEANING: Prior to vacating the premises, renter agrees to:
-Clean and put away all dishes. It is acceptable to turn the dishwasher on just prior to leaving.
-Remove all garbage. Place in tied garbage bags in the garbage cans in the garage. No loose items, please!
-Remove all food brought with the renter.
-Wipe down kitchen Including: counters, sink, table, and appliances.
-Take sheets off of the beds and leave in the center of the beds.
-Leave dirty towels and linens in the laundry basket.
-Wipe down bathrooms including: sinks, showers, and toilets.
-Broom sweep floors.
Failure to meet these conditions will result in a cleaning fee of $275.00, to be withheld from RENTER’S security deposit.
5.SMOKING. It is agreed that there is no smoking in the dwelling, on the porches or decks, or on the dwelling property. Any violation of this policy shall result in a breach of this agreement and the tenant agrees to vacate the premises and forfeit all rent and security monies.
6.USE. RENTER agrees that the maximum daily use or nightly occupancy of the premises is limited to THE NUMBER OF PERSONS AGREED UPON THROUGH RENTAL WEBSITE. All occupants must be registered on the short term lease agreement. No other persons shall enter the Rental Property at any time. Each occupant over the age of eighteen (18) shall be equally responsible for observing Terms and Conditions specified in the Rental Agreement. Any violation of this agreement, without the written consent of the LANDLORD, shall result in a breach of this agreement and the tenant agrees to vacate the premises and forfeit all rent and security monies.
7.UTILITIES: The Owner shall make every effort to provide local phone service, cable or satelliteservice, and energy to heat the home. However, the homeowner is not responsible due to acts of God (bad weather, trees falling over lines, cut wires, or power outages) and other causes outside of Owner’s control, that affect the provision of such utilities. Long distance phone calls will be charged back with an additional $15.00 surcharge. Cell phones seldom work in our remote area. Please purchase a calling card. They are usually very inexpensive.
8.LIST OF ALL OCCUPANTS (AND AGES): to be provided by renter
9.SUB-LET/ASSIGNMENT. RENTER shall not sub-let or assign his/her rights under this Agreement in any manner.
10.CHECK IN/CHECK OUT TIMES: On the day of arrival, guests are welcome to arrive no earlier than 4 PM. On the day of departure, the premises must be completely vacated (including all occupant’s possesions) by 11 AM. Guests who arrive early or depart late without the express consent of the owner, will be subject to loss of security deposit and a 50 dollar per half hour fee.
11.CANCELLATION POLICY. If written notification of cancellation is received by the OWNER at least 7 days prior to the start of the lease term, 50% of the lease total (minus AIRBNB fees) will be returned. Any cancellation request made later than 7 days prior to the start of the lease will result in the forfeiture of the full lease amount.
